These Terms of Service ("Terms") govern your use of The Cardshark Emporium website, online store and related services, including purchasing products and using our Click & Collect service.
By accessing our website, placing an order or otherwise using our services, you agree to these Terms.
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies available to consumers under the Australian Consumer Law or any other rights that cannot lawfully be excluded.
1. About The Cardshark Emporium
The Cardshark Emporium is an Australian trading card and collectibles retailer based in Beveridge, Victoria.
We specialise in trading card games, sealed trading card products, individual cards, graded cards, collectibles, accessories and other related products.

2. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, website, services, legal obligations or operating practices.
The latest version of these Terms will be published on our website and the "Last updated" date at the top of this page will be updated accordingly.
Changes will apply from the date the updated Terms are published unless otherwise stated.
3. Products and Product Information
We take reasonable care to provide accurate product descriptions, photographs, specifications, availability information and other product details.
Colours, packaging and product appearance may vary slightly from images displayed on a screen or from manufacturer promotional images.
Manufacturers may also make changes to product packaging or presentation without notice.
For trading card products containing randomised contents, individual cards, rarities, pull rates or values are not guaranteed unless expressly stated in the product listing.
Product images may sometimes be manufacturer or promotional images and are provided for illustrative purposes unless a listing specifically states that the exact item pictured will be supplied.
For individual or graded cards where photographs of the actual item are provided, customers should review those photographs and the product description before purchasing.
Nothing in this section limits your rights under the Australian Consumer Law where goods do not correspond with their description or otherwise fail to meet an applicable consumer guarantee.
4. Pricing
Unless otherwise stated, prices displayed on our Australian online store are in Australian Dollars (AUD).
Prices displayed at the time an order is placed will generally apply to that order once accepted by us.
We may change prices for future purchases at any time, including in response to supplier pricing, market conditions, exchange rates, promotions or other commercial factors.
A later increase or decrease in the advertised price of a product does not ordinarily alter the price of an order that has already been accepted.
If a product is accidentally listed at an obviously incorrect price due to a technical, administrative or pricing error, we may contact you before fulfilling the order to explain the issue and provide appropriate options, including cancellation and a refund where applicable.
Nothing in this section limits any rights available under Australian law.
5. Product Availability
Products displayed on our website are subject to availability.
Adding a product to your shopping cart does not reserve the product.
Although we endeavour to maintain accurate inventory information, stock discrepancies can occasionally occur due to simultaneous purchases, inventory errors, damaged stock, supplier issues or other circumstances.
If we cannot fulfil an order after payment has been made, we will contact you and provide an appropriate resolution, which may include a refund for the unavailable item.
6. Placing an Order
Orders may be placed through our online store using the purchasing options available at checkout.
When you place an order, you are making an offer to purchase the selected products subject to these Terms.
We reserve the right to refuse or cancel an order where reasonably necessary, including where we reasonably suspect fraud or unauthorised payment activity; a product is unavailable; there has been an obvious pricing or listing error; payment cannot be successfully processed; delivery cannot reasonably be completed; or an order breaches these Terms or applicable law.
Where an order is cancelled after payment has been received and the customer is entitled to a refund, the applicable amount will be refunded using the original payment method or another appropriate method where required.
7. Payment
Full payment is generally required when an order is placed unless another payment arrangement is expressly offered.
Available payment methods are displayed during checkout.
Payments are processed using Shopify and/or authorised third-party payment providers.
The Cardshark Emporium generally does not receive or store complete credit or debit card details.
Customers are responsible for ensuring that the payment information supplied is accurate and that they are authorised to use the selected payment method.
8. Order Confirmation
After successfully placing an order, you should receive an order confirmation using the contact details supplied during checkout.
Please review your confirmation and contact us promptly if you notice an error.

9. Shipping and Delivery
Shipping options, estimated delivery information and applicable shipping charges are provided through our website and checkout where available.
Orders are prepared and dispatched in accordance with our current Shipping Policy.
Delivery estimates are estimates only and may be affected by postal networks, couriers, weather, public holidays, peak periods, incorrect delivery information and other circumstances outside our reasonable control.
Customers are responsible for providing accurate delivery information when placing an order.
If you notice an incorrect delivery address after ordering, please contact us as soon as possible. We cannot guarantee that an address can be changed once an order has entered processing or has been dispatched.
Our Shipping Policy should be read together with these Terms.
10. Click & Collect
Where offered, customers may select Click & Collect during checkout.
Click & Collect is available from our designated collection location in Beveridge, Victoria.
Our collection location is not necessarily a general walk-in retail store. Customers should wait until they have received confirmation that their order is ready before attending for collection.
Collection instructions and any applicable collection details will be provided after the order has been processed.
We may request the order confirmation and suitable identification before releasing an order, particularly for higher-value purchases or where reasonably required to prevent fraud.
If another person will be collecting an order on your behalf, please contact us beforehand where required so appropriate arrangements can be made.
Orders should be collected within the timeframe communicated to you.
If an order remains uncollected for an extended period, we will attempt to contact you to arrange collection or another appropriate resolution.
11. Returns, Refunds and Exchanges
Our Returns & Refund Policy applies to returns, refunds, exchanges, damaged products, incorrect products and eligible change-of-mind requests.
Eligible change-of-mind return requests may be made within 30 days of receiving an order, subject to the requirements contained in our Returns & Refund Policy.
For change-of-mind returns involving sealed trading card products or collectibles, products must generally remain unused, unopened and in their original condition, with factory seals, shrink-wrap and protective packaging intact.
Due to the nature of trading card products, opening a product and being dissatisfied with the cards, rarities, pulls or market value of its contents does not by itself make the product faulty.
Nothing in these Terms or our Returns & Refund Policy excludes, restricts or modifies rights or remedies available under the Australian Consumer Law.

12. Damaged, Faulty or Incorrect Products
If you believe an item has arrived damaged, is faulty, was incorrectly supplied or does not match its description, please contact us as soon as reasonably practicable.
We may request your order number, photographs of the product and packaging, and other information reasonably required to investigate the issue.
Depending on the circumstances and your rights under Australian Consumer Law, an appropriate remedy may include repair, replacement, refund or another remedy.
Our Returns & Refund Policy contains further information about damaged, faulty and incorrect products.
13. Pre-Orders
Some products may be offered for purchase before their expected release or availability date.
Release dates and expected arrival dates may be changed by manufacturers, distributors, suppliers, freight providers or other parties outside our control.
Dates shown for pre-order products should therefore be treated as expected dates unless expressly stated otherwise.
We will endeavour to provide relevant updates where a material delay becomes known to us.
Any additional terms disclosed on a particular pre-order product page should be reviewed before purchasing.
Nothing relating to pre-orders limits rights or remedies that cannot legally be excluded under Australian Consumer Law.
14. Trading Cards and Collectibles
Trading cards and collectibles may fluctuate significantly in market value.
The Cardshark Emporium does not guarantee that a product will maintain or increase its market value after purchase.
Market prices may change after an order is placed due to supply, demand, product releases, reprints, grading outcomes, tournament results or other market conditions.
Unless expressly stated otherwise, purchasing a trading card product is a purchase of the product itself and is not an investment product or guarantee of future financial value.
15. Graded Cards
Where a trading card has been professionally graded by a third-party grading company, the grade displayed is the opinion and determination of that grading company.
The Cardshark Emporium does not independently guarantee or reproduce the grading company's assessment.
Customers should review available photographs, grading information and certification details before purchasing.
Nothing in this section limits rights relating to an item being incorrectly described or otherwise failing to comply with applicable consumer guarantees.
16. Promotions, Discounts and Discount Codes
From time to time, The Cardshark Emporium may offer promotions, giveaways, discounts or promotional codes.
Additional conditions may apply to a particular promotion and will be communicated with the relevant offer where applicable.
Unless otherwise stated, discount codes cannot be exchanged for cash and may not be combined with other promotions.
We may withdraw or amend promotional offers where reasonably necessary, subject to orders already accepted and applicable law.
17. Gift Cards
Gift cards may be subject to additional conditions displayed when purchased or issued.
Gift cards are generally not redeemable for cash except where required by law.
Customers are responsible for keeping gift card information secure.

Third-party trademarks, trading card artwork, character artwork, product images and other intellectual property remain the property of their respective owners.
Nothing on our website grants permission to reproduce, distribute or commercially exploit our intellectual property without permission.

Our website may contain links to or integrations with third-party websites and services.
These third parties operate independently and may have their own terms, policies and practices.
We are not responsible for third-party websites or services except to the extent responsibility cannot legally be excluded.
22. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Where legislation implies a guarantee, condition, warranty or remedy that cannot legally be excluded, these Terms operate subject to that legislation.
23. Limitation of Liability
To the maximum extent permitted by law, The Cardshark Emporium will not be liable for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability or remedies that cannot be excluded under the Australian Consumer Law.
Any limitation contained in these Terms applies only to the extent permitted by applicable law.
24. Governing Law
These Terms are governed by the laws applicable in Victoria, Australia.
Subject to any rights you may have under applicable consumer law, disputes relating to these Terms or our services will be subject to the jurisdiction of the courts and tribunals of Victoria and any other court or tribunal with applicable jurisdiction.
25. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where possible.
The remaining provisions will continue to operate.
